BlueScope Steel is trying to stop the Land and Environment Court approving a painting production line installed by Ace Gutters in a light industrial area at Mortdale. Ace Gutters had bought painted-steel products from BlueScope and now seeks to be a competitor. Ace had appealed against a decision by Hurstville Council to refuse consent for the 100-metre-long steel-painting line it had installed. BlueScope was refused leave to join this case but launched a new action when Ace and the council reached agreement. The commissioner, Trevor Bly, found the development complied as "light industry" but had not yet made formal orders.

Mallesons Stephen Jaques the lawyers for BlueScope, contend the paint line is banned under Hurstville's local environment plan. The case is expected back in courton Friday.
